In Mittelpunkt der am 19. September 2019 verkündeten Entscheidung C-34/18 (Lovasné/ERSTE) des Europäischen Gerichtshofes steht erneut eine Vollstreckungsklausel bei einem Hypothekendarlehen. Im Gegensatz zur Mehrheit der vorigen Hypotheken-Entscheidungen des EuGH geht es hier jedoch weder um Berechnungsmethoden für Zinsen , die Durchführbarkeit von Klauselkontrollen ex-officio oder um die AGB-rechtliche Wirksamkeit von notariellen Schuldanerkenntnissen. Im Lovasné-Fall wird der Fokus auf die Erschwerung der Beweislast zulasten des Verbrauchers im Falle einer Zwangsvollstreckung gelegt. Außerdem sind die Problematik des Ausschlusses des Zugangs zur Streitbeilegung und Fragen hinsichtlich unterschiedlicher Sprachauffassungen von europäischen Vorschriften berührt. Nach kurzer Darstellung des Ausgangstreites (1.) prüft der Artikel, ob der Verbraucher in einem Zwangsvollstreckungsverfahren aus Sicht der Beweislast in einer schwächeren Position ist als in einem üblichen Verfahren (2.) und ob der Zugang zur Streitbeilegung wegen der unmittelbaren Vollstreckung tatsächlich ausgeschlossen ist?


The focus of Decision C-34/18 (Lovasné / ERSTE) of the European Court of Justice, announced on September 19 2019, concerns the difficulty of excluding or hindering the consumer's right to take legal action in response to a court enforcement procedure and the exclusion of access to out-of-court dispute resolution. In spite of the questions unsuccessfully raised by the Budapest Regional Court of Appeal and the imprecise translation of the controversial clauses of the Hungarian so-called black list, the CJEU ruled that clauses that make it more difficult for consumers to take legal action (or access out-of-court dispute resolution) are regarded as unfair. However, it is up to the national court to answer whether the contested clause should be considered unfair on the basis of the implementing Hungarian standards. After explaining the Hungarian regulations, it has to be said that it can hardly be disputed that the strict deadlines for the provision of evidence and the risk of multiplication of litigation costs in a court enforcement can prevent the consumer from bringing the action. The consumer is also in a weaker position regarding the archiving of documents and the court costs that have to be paid upfront, even if later reimbursed by legal assistance. In addition, the Hungarian courts will have to examine in great detail whether the submitted contracts provide sufficient opportunity for an out-of-court dispute resolution in the course of the legal relationship. This is because the exclusion or obstruction of alternative dispute resolutions by a contractual clause, in the event that the financial institution has issued a general declaration of submission or if the amount in dispute remained below the 1 million HUF hurdle, must be regarded as unfair.
