Příspěvek se zabývá hledáním a identifikací „nového“ v prostředí existence práva a zejména legislativy v České republice v období po roce 1990, resp. mezi lety 1993 až 2013 a reakcí legislativy na tyto „novoty“. Na základě kvantitativní deskripce a analýzy některých vlastností, aspektů a součástí legislativy ČR a jejich vývoje prezentuje a dokládá autor zejména tezi o hypertrofii českého zákonodárství v uvedeném období jako jeho dominantní vývojovou tendenci, kterou nelze ovšem hodnotit zásadně pozitivně.

The contribution deals with the research and identification of „the new“ in the surroundings of law especially in the Czech republic in the period after 1990 or more exactly between years 1993 and 2013 and the reaction of legislature on this news. On the basis of the quantitative description and analysis of some selected features and parts of the Czech legislature and its development the autor presents and argue first of all the thesis about so called „hypertrophy“ of the Czech legislation in the above mentioned period as the dominant tendency of its development that cannot be evaluated positivelly in principle.
