The paper concentrates on the substantive human right to environment at the national level. Firstly, it analyses the constitutional recognition and practical enforcement of the right to a favourable environment in the Czech Republic, where the right is rarely applied. Then it reflects on general preconditions that seem to be crucial in order to have the substantive human right related to the environment, a functioning part of the environmental protection.
