The conference addresses arguments for justifying political authority and obligation, namely the role played by human rights and political activity in the building of the polis. It considers the institution of judicial review in which the constitutional courts find themselves charged with the duty to protect as well as reflect. The conference considers whether this practice conflicts with or helps to further democracy’s underlying value when such authority seems to be justified only insofar as it realizes democratic values.
