Nad právní úpravou promlčení se otevírá řada různých otázek. Některé se odvíjejí od koncepce úpravy, jiné od jejího obsahu a další ovlivňují důsledky použité technologie. Pro majetková práva z toho plynou výrazné praktické dopady. Na ty podstané poukazuje následující příspěvek, přičemž u některých z nich usiluje nabídnout řešení. Současně uvádí, jak k uvedeným otázkám přistupuje návrh nového občanského zákoníku.

A number of various questions arise in respect of the legal regulation of time bar. Some of them derive from the concept of the regulation, others from its contents, and further questions arise in respect of the consequences of the technology used. Significant practical impacts result where proprietary rights are taken into consideration. The substantial ones are pointed out in the following contribution and the author attempts to offer solutions of some of them. At the same time, he states the approach of the proposal of the new Civil Code to the given questions.
