Annotation
Profesor Antonín Hobza byl zakladatelskou osobností české, respektive československé nauky mezinárodního práva.Byl profesorem Právnické fakulty Univerzity Karlovy v Praze, členem Institutu mezinárodního práva (IDI) a ke konci života členem Československé akademie věd a zakladatelem Kabinetu mezinárodního práva. Profesor Hobza ve své osobě spojoval teoretické a praktické znalosti mezinárodního práva. Díky svým zkušenostem z práce na Ministerstvu zahraničních věcí v prvních letech Československé republiky a zastupování státu před arbitrážními tribunály se snažil vždy vykládat svůj obor bez přílišného teoretizování (či spekulací) jako obor pozitivního práva. Kriticky se vymezoval vůči normativismu (ryzí nauce právní). V řadě aspektů byly jeho názory velmi moderní, např. v otázce možné subjektivity jednotlivců, nikoli neomezené suverenity států, role mezinárodních organizací a vyloučení války jako prostředku řešení mezinárodních sporů.
Description in English
Professor Antonín Hobza was a founding figure of Czech or rather Czechoslovak doctrine of international law.He was professor of Law at Law Faculty of Charles University in Prague, member of the Institut de Droit International and in the last years of his life a member of the Czechoslovak Academy of Sciences and founder of the Cabinet of International Law. Professor Hobza’s personality combined both theory and practice of International Law. Thanks to his work experience from the Ministry of Foreign Affairs during the early years of the new Czechoslovak Republic and his representation of the State before arbitration tribunals, he always aimed at teaching without unnecessary theoretical speculations, as a branch of positive law. He took critical stance towards the pure theory of law (normativist school). His teachings were quite modern in many aspects, such as the issue of personality of individuals, non-absolute sovereignty of States, and the role of international organizations and excluding war as a means of settling international disputes.
