Language cze - Czech Country CZ - Czech Republic Keywords international public law ; euroamendment ; Czech law Subject RIV AG - Legal Sciences CEZ AV0Z70680506 - USP-I (2005-2011) Annotation Článek analyzuje vztah českého práva k mezinárodnímu právu veřejnému v perspektivě deseti let od "euronovely" Ústavy a s spolu s tím přístupy, které k aplikaci mezinárodního práva volí české správní orgány a soudy. V té souvislosti konstatuje, že zatímco běžně dochází k aplikaci mezinárodních smluv podle čl. 10 Ústavy, nejednoznačné zůstávají přístupy k ostatním pramenům mezinárodního práva, což i pro české poměry ukazuje na nevýstižnost tradičně užívaných konceptů monismu a dualismu při popisu vztahu k mezinárodnímu právu. Description in English The article analyzes the effects of public international law in Czech law in the perspective of 10 years since the "euroamendment" of the Czech Constitution and, consequently, the approach of Czech administrative bodies and courts to public international law. In this respect, the article concludes that while treaties under art. 10 of the Constitution are regularly applied, approcah to other rules of international law reamins ambiguous which tends to confirm that even in the Czech conditions concepts of monism and dualism are inapt to describe the realtion between national and international law.
