Tento článek představuje obecné problémy a zároveň příležitosti při využívání umělé inteligence v oblasti normotvorby a soudnictví. Článek dochází k závěru, že v oblasti normotvory je nezbytné, aby konečné normy byly kontrolovány a schvalovány demokraticky volenými zástupci. V oblasti soudnictví je pak nutné prozkoumat v souvislosti s automatizací justice rozsah a limity práva na řádný a spravedlivý proces a nastavení právních, organizačních a technických záruk systémů umělé inteligence pro podporu soudního rozhodování.

This article presents both general challenges and opportunities in the use of artificial intelligence for law-making and judicial decision-making. The article concludes that in the field of law-making, it is essential that norms and laws are controlled and approved by democratically elected representatives. In the field of automated judicial decision-making, it is then necessary to examine the scope and limits of the right to a due and fair trial as well as legal, organizational, and technical safeguards for AI systems that support judicial decision-making.
