Kapitola zkoumá omezování svobody projevu v rozhodování soudů. Zabývá se vybranými rozhodnutími Evropského soudu pro lidská práva ve Štrasburku, rozhodovací činností českého Ústavního soudu a českého Nejvyššího soudu. Podrobněji diskutována jsou mj. rozhodnutí ve věci M. Š. proti R-Presse, H. V. proti Europress, a P. S. a M. S. proti Vltava-Labe-Press. Autor si zároveň klade otázku po příčinách růstu omezování svobody projevu a nedostatečné reflexe svobody projevu v českých médiích. Kapitola probližuje rovněž problematiku dehonestace a problematiku whistleblowingu.


The chapter examines restrictions on freedom of expression in court decisions. It deals with selected decisions of the European Court of Human Rights in Strasbourg, decision-making activities of the Constitutional Court and the Supreme Court of the Czech Republic. The decisions in M. Š. vs R-Presse, H. V. vs Europress, and P. S. and M. S. vs Vltava-Labe-Press are discussed in more detail. At the same time, the author raises the question of the reasons for the growth of restrictions on freedom of expression and insufficient reflection on freedom of expression in the Czech media. The chapter also discusses the issue of defamation and the issue whistleblowing.
