Protože legal origins thesis pracuje s představou právního původu země, článek se dále věnuje problematickému nalezení právního původu právního řádu konkrétní země.Nakonec provádí analýzu pojmů právní kultury, velkého právního systému, právní rodiny a právní tradice, aby upozornil na to, že těchto pojmů rozdílně užívá právní komparatistika, právní sociologie a srovnávací právní historie. Description in English The article starts with the presentation of fundamental ideas of legal origins thesis (on the “law and economics” background) which, to put it simply, states that the origin of the legal order of a particular country (in common law or in civil law) is a decisive factor for the economic development of the country. It criticizes this thesis, first from the methodological viewpoint: It points out that not only the collection of data is problematic, but also the choice of research criteria and their quantification; it also stresses the problematic character of empirical research in law as such. Because legal origins thesis uses the concept of legal origin of a country, the article also points out the problem of classification of countries according to their legal origins. Then it proceeds with the analysis of concepts of legal culture, legal family, legal system and legal tradition and pays particular attention to the fact, how these concepts are differently used by comparative law, sociology of law and comparative legal history.
