Článek zkoumá současný status a budoucí perspektivy práva životního prostředí jako jednoho ze základních lidských práv. Rozšíření katalogu lidských práv o toto právo se jeví jako nový nadějný prostředek právní ochrany životního prostředí. Autorka se blíže zabývá specifiky životního prostředí jakožto hodnoty velmi odlišné od hodnot tradičně chráněných pomocí lidských práv; tato specifika ztěžují formulování i případné mechanismy ochrany takového práva.

The article analyses the current status and future perspectives of the basic right to environment. Extending the human rights catalogue with this new right seems to enrich the legal instruments of the environmental protection by a new promising one. However, the author proves that the environment is characterized by several particularities, differing it from any other values protected by the means of human rights, that make the formulation and recognition of the right uneasy.
