In the Czech Republic, the archaeological heritage care, as well as conducting archaeological research, is predominantly affected by the outdated legislation that was adopted already during the Communist era and focused on the needs of a centrally-managed socialist state with minimal experience with private business and the market economy system. The Act on the State Landmark Conservation came into force in 1988 and currently remains as one of the last socialist relicts not only in the legislative system of the Czech Republic but also in the sphere of monument protection on the European level as it is the oldest regulation in the post-communist countries of Central and Eastern Europe.
