Vedle limitů stanovených federální Ústavou a jejími dodatky a – dále a kontroverzněji – též zákony Kongresu, rozvinulo samo federální soudnictví několik doktrín justiciability, které odrazují federální soudy od toho, aby rozhodovaly o určitých kategoriích případů, v nichž buď ohled na ústavní text, nebo soudcovská obezřetnost odůvodňují, aby si soudy počínaly zdrženlivě. V rámci těchto doktrín je z hlediska debaty o právu a politice rozhodně nejzajímavější doktrína politické otázky. Článek proto podává přehled o vývoji klasické doktríny politické otázky, jejíž počátky jsou zpravidla hledány u případu Marbury v. Madison a která dosáhla svého vrcholu v první polovině 20. století. Description in English Contrary to widespread beliefes, US federal courts have been designed as the courts of limited jurisdiction. Apart from the limits imposed by the federal Constitution, its amendments and, more controversially, also by the Acts of Congress, the federal judiciary itself has developed several judiciability doctrines which discourage the federal courts from ruling on certain categories of cases where either the respect to the constitutional text or judicial prudence justify courts to exhibit judicial self-restraint. Of these doctrines, the political question doctrine is definitely the most interesting in terms of the debate on law and politics. Thus, the article provides an overview of the evolution of the classical political question doctrine the origins of which are usually traced to Marbury v. Madison case and which reached its zenith in the first half of the 20th century.
