Text analyzuje posun evropského korporačního práva po roce 2010, a to nejen pohledem českého práva, ale také pohledem trendů v samotné Evropě. Poukazuje na postupný odklon pozornosti evropského zákonodárce od regulace obchodních společností směrem k jiným tématům. Ukazuje, že se ale nejedná o krok zpět, ale spíše o úkrok směrem k regulaci insolvenčního práva či regulaci preventivní restrukturace. Současně sleduje příklon k částečně vedlejším aspektům korporačního práva, zejména k ESG nebo enviromentální či klimatické ochraně.

The text analyses the shift in European corporate law after 2010, not only from the perspective of Czech law, but also from the perspective of trends in Europe itself. It points out the gradual shift of the European legislator's attention away from corporate regulation towards other topics. However, it shows that this is not a step backwards, but rather a move towards the regulation of insolvency law or the regulation of preventive restructuring. At the same time, it traces a move towards partly secondary aspects of corporate law, in particular ESG or environmental or climate protection.
