Kapitola Nakládání s plody po potratu a plody po umělém přerušení těhotenství poukazuje na některé právní nejasnosti související s povinnostmi poskytovatelů zdravotních služeb zajistit uložení plodů, jejich vydání na žádost oprávněné osoby a povinnosti jejich specifického pohřbení. Kapitola připomíná, že již od roku 2017 mají rodiče právo na vydání plodu k pohřbení. Do roku 2017 tuto možnost rodiče neměli. V souvislosti s touto povinností zákon o zdravotních službách nově zakotvuje také specifický režim zpopelnění plodu v případě, že si rodiče plod nevyžádají k pohřbení. Nově zákon stanoví, že se plody zpopelňují odděleně od patologicko-anatomického odpadu.

The chapter on the management of foetuses after abortion and foetuses after artificial termination of pregnancy highlights some legal uncertainties related to the obligations of health care providers to ensure the storage of foetuses, their release at the request of a beneficiary and the obligation of their specific burial. The chapter reminds that as of 2017, parents already have the right to have the fetus released for burial. Prior to 2017, parents did not have this option. In connection with this obligation, the Health Services Act also newly establishes a specific regime for fetal cremation in the event that the parents do not request the fetus for burial. The new law provides that fetuses are cremated separately from pathological and anatomical waste.
