Takovýto SOE je běžnou soukromou společností a vliv státu se má realizovat výkonem jeho společnických práv při kterém stát může zohledňovat také širší veřejné zájmy. Pozice státu však nesmí být zneužita nebo využita způsobem, který poškodí další akcionáře. SOE není subjektem veřejného práva. Description in English The existence of an SOE in which the state does not own a 100% stake is not in itself a reason for special corporate governance. Such an SOE is a private company and the influence of the state is to be realized by exercising its shareholder´s rights, in which the state can also take into account the wider public interests. However, the position of the state must not be abused or misused in a way that harms other shareholders. The SOE is not a body governed by public law.
