Současně se ale nejedná o aplikaci přímou, ale musíme zkoumat podstatu osoby veřejného práva. Článek klade základní limity toho, kdy se na řízení a správu právnických osob veřejného práva použijí fiduciární povinnosti, a kde již spíše ne. Systémově dochází k závěru, že není důvodu obecně dovozovat, že např. pro řízení univerzit, krajů či obcí neplatí povinnost jednat s péčí řádného hospodáře. Současně však nutno zkoumat jak účel těchto právnických osob, tak smysl konkrétních jejich orgánů. Description in English The Civil Code presupposes the fundamental applicability of the rules on legal persons also to public law persons. At the same time, however, this is not a direct application, but we must examine the nature of the public law person. The article puts basic limits on when fiduciary duties apply to the management and administration of public law legal persons and where they rather do not. Systematically, it concludes that there is no reason to assume in general that the duty to act with due care does not apply to the management of universities, regions or municipalities, for example. At the same time, however, it is necessary to examine both the purpose of these legal persons and the purpose of their specific bodies.
