Za tím účelem analyzuje jednak judikaturu obou prvorepublikových nejvyšších soudů (Nejvyššího soudu, Nejvyššího správního soudu), jednak to, jak bylo o obou sporech referováno v právnických časopisech i v novinách. Dochází k závěru, že ministerstvo spravedlnosti pod vedením německého ministra Mayr-Hartinga pravděpodobně přispělo k tomu, že první spor eskaloval právě v r. 1928 a přerostl až k téměř otevřený ústavní konflikt mezi ministerstvem a Nejvyšším soudem. V případě druhého sporu nabízí hypotézy, proč Nejvyšší správní soud v r. 1929 změnil svou původní judikaturu příznivou pro menšinové obce. Description in English The chapter tries to study the political influence on the judicial decision-making using the example of two language disputes that arose in front of two Czechoslovak apex courts (Supreme Court, Supreme Administrative Court) between 1928 and 1929. The first dispute concerns the question, whether foreigners can use a minority language (mostly German) according to the same conditions as Czechoslovak citizens, the second one concerns the question, what is the language of official letters between two municipalities with different official languages (Czechoslovak and German). The text analyzes in detail the case law of the two apex courts and studies law journals and newspapers. In the case of the first dispute it concludes that the ministry of justice headed by German minister Mayr-Harting probably contributed to the escalation of the dispute in 1928 (to the extent of the open constitutional conflict between ministry and the Supreme Court). In the case of the second dispute the text offers some hypotheses, why the Supreme Administrative Court in 1929 changed its previous case law originally favorable for municipalities using minority language (usually Germans).
