The Rulers and the Ruled is a legal monography overlapping into related philosophical disciplines, particularly ethics and political philosophy. Thematically it focuses on normativity, legitimacy, and collective agency issues, drawing methodologically on the traditions of analytical philosophy and on the emerging theory of normativity, the so-called theory of control, which it also develops. The book asks how to reconcile theories of democratic legitimacy with the existence of individuals incapable of autonomous action, such as young children or the mentally disabled. If theories of democratic legitimacy assume that people are capable of self-government, then young children or the mentally disabled are not. The book demonstrates that the instrument of governance is the normative influence of each member of society, and identifying such an instrument makes it possible to justify the positive obligations of society to each individual.
