Cílem knihy je hledání odpovědi na tři hlavní otázky, a to: ‚Existuje konsensus mezi náboženskými učenci co do léčby neplodnosti, nebo lze hovořit o pluralitě právních názorů?′, ‚Co je smyslem, cílem omezení metod asistované reprodukce?‵ a ‚Na jakém základě jsou konkrétní metody asistované reprodukce dovoleny nebo zakázány?‵. Ke všem třem otázkám je přistupováno z pohledu islámského (‚náboženského‵) práva a práva muslimských zemí (‚státního‵ práva). Tato kniha začíná s úvodem do pravidel rodinného práva souvisejících s metodami asistované reprodukce. Následující kapitoly představují právní rámec pro metody asistované reprodukce podle postojů sunnitských a ší’itských učenců, vztah mezi náboženským a státním právem, následně jsou prezentovány základní metody asistované reprodukce (IUI a IVF), včetně dárcovství gamet a náhradního mateřství. Description in English This book deal with medical treatment of infertility in Islamic law and laws of Muslim countries. The aim of the book is to answer three key questions, namely: ″Is there a consensus among religious scholars on treatments of infertility or is there a plurality of opinions?”, ″What is the goal of restrictions in ART?″ and ″On which grounds are particular methods of ART permitted or outlawed?″. All three questions are addressed from the perspective of Islamic law (″religious law″) and law of Muslim countries (″state law″). The book starts with introduction into ART’s related family law related rules. Following chapters explore the legal framework for ART according to the position of Sunni and Shia scholars, the relationship between religious law and state law, further are presented basic methods of treating infertility (IUI and IVF), including gamete donation and surrogate motherhood.
