This contribution analyses the use of legal provisions on intergeneration justice (explicit or implicit) and the Paris Agreement in climate change litigation involving the rights of children and young people. The contribution suggests that the provisions of the Paris Agreement thanks to their greater specificity are playing a more important role in the current climate change litigation (and legislation) than the provisions on intergenerational justice although these provisions are on the rise in national constitutions.
