The growing trend of human-right based climate change litigation involving the rights of children and young people imposes a question of whether explicit legal provision on intergenerational justice may provide an improved climate legislation and performance and could thus help to overcome the problem of complexity of environmental and climate crisis. This contribution discovers the legal provisions on intergenerational justice (either explicit or implicit) and their use in current climate change litigation.
