Příspěvek ve sborníku se zabývá tzv. legal origin thesis, kterou zastávají někteří současní ekonomové, podle niž (jednoduše řečeno) je pro hospodářský rozvoj země výhodnější common law, než kontinentální právo. Protože tato teze má dopady i pro právní komparatistiku a teorii práva obecně, je podána kritika z pohledu metodologických předpokladů této teze, metody sběru dat podporujících tuto tezi, právní komparatistiky a právní historie.

The contribution to the anthology deals with a so-called legal origin thesis which is supported by some of the contemporary economists according to whom, simply put, common law is more favourable than continental law as far as economic development of a state is concerned. As this thesis has also impact on comparative jurisprudence and theory of law in general, the review is presented from the point of view of methodological hypotheses of the thesis, methods of collection of data supporting the thesis, comparative jurisprudence and the history of law.
