Předmětem příspěvku je stručná analýza některých problémů vyplývajících z dosavadní zákonné úpravy státní a veřejné služby v ČR a vymezení klíčových otázek navrhované regulace. V této souvislosti si autor všímá zejména možností a mezí právní regulace daných na jedné straně nezbytnou mírou pružnosti výkonu veřejné správy a na druhé straně politickou kulturou.

The subjects of the contribution are a brief analysis of some problems arising from the current legal regulation of the civil and public service in the Czech Republic and a definition of the key questions of the proposed legislation. In this context, the author notes mainly the possibilities and limits of the legal regulation which are based on both the essential extent of flexibility of execution of public administration and the political culture.
