Článek 5 Římského statutu stanovil, že jurisdikce Mezinárodního trestního soudu se bude vztahovat na nejzávažnějčí zločiny, jako je zločin genocidy, zločiny proti lidskosti, válečné zločiny a zločin agrese. Zločin agrese však stále zůstává nedefinován.

Article 5 of the Rome Statute limits the jurisdiction of the International Criminal Court to the serious ccrimes of concern to the international community as a whole, particularly to the crime of genocide, crimes against humanity, war crimes and crime of aggression. The crime of aggression remains undefinied.
