Základní lidská a občanská práva považuje autor za práva přirozená z hlediska jejich podstaty. Jsou základním souborem hodnot demokratické společnosti. právo na zdravé životní prostředí vzniká zásadně tehdy, dochází-li k natolik vážné devastaci životního prostředí. Péče a ochrana životního prostředí by neměla být pouze záležitostí státu, ale měla by být postavena do středu každého jednotlivce, vybaveného k tomu tím nejzávažnějším právním a ústavním prostředkem - základním lidským a občanským právem.

The author considers fundamental human and civil rights as natural rights in their essence. They represent the fundamental set of values of democratic society. The right to healthy environment originates principally, if the devastation of the environment is so serious that it begins to threaten directly the very existence of mankind and all forms of life connected therewith. Environment care and protection should not be merely the affair of the state, but should be put into the centre of interest of every individual provided therefor by the most serious legal and constitutional instrument - the fundamental human and civil right.
