Text je úvodní kapitolou v kolektivní monografii o právní argumentaci a zabývá se povahou argumentace a praktickou potřebou argumentovat. Autorův přístup vychází z diskurzivní etiky, takže argumentaci uvažuje primárně jako sdílené úsilí o vzájemné porozumění. Argumentace je inter-subjektivní aktivita, která ztělesňuje respekt k diskusním partnerům jako rovným a svobodným osobám. V tomto smyslu má argumentace svoji vnitřní morálku.

This is the opening chapter in a collective monograph on legal argumentation. The text discusses the nature of argumentation and the practical need to argue. The author's approach is based on discursive ethics, so he considers argumentation primarily as a shared effort to understand each other. Argumentation is an inter-subjective activity that embodies respect for discussion partners as equal and free persons. In this sense, the argumentation has its own internal morality.
