Tato kapitola analyzuje vývoj a současnou roli doktrín postulujících nejusticiabilitu politických otázek. Osvětluje rovněž hlavní způsoby legitimizace těchto doktrín, úzce spjatých s principem dělby moci, v právních systémech Spojených států, Francie a Spojeného království. Na tomto pozadí je argumentováno, že srovnatelná doktrína nejusticiability některých politických otázek se objevila v judikatuře českého Ústavního soudu, v níž je srovnatelně se zahraničními protějšky často vnímána jako důsledek principu dělby moci.

The present chapter analyses the evolution and the present role of doctrines which postulate non-justiciability of political questions. It also sheds light on the principal modes of legitimization of these doctrines, closely linked to the separation of powers principle, in the legal systems of the United States, France and the United Kingdom. Against this background, it is argued that comparable doctrine of non-justiciability of certain political questions has emerged in the case-law of the Czech Constitutional Court in which, comparably to its foreign counterparts, it is often viewed as a corollary of the separation of powers principle.
