Umělá inteligence se stále častěji využívá v produktech určených pro spotřebitele. Umělá inteligence může představovat rizika pro uživatele, zejména riziko nedostatku kontroly nad produktem, ztrátu soukromí nebo nebezpeční diskriminace. Velkým rizikem spojeným s možností umělé inteligence autonomně (bez lidského zásahu) rozhodovat je nedostatek transparentnosti za prvé o tom, podle jakých kritérií umělá inteligence rozhoduje, a za druhé, že je vůbec umělá inteligence v produktu využita. Spotřebitel je považován za slabší smluvní stranu. Proto mu právo poskytuje zvláštní ochranu. Jedním z nejdůležitějších práv spotřebitele je právo na informace a z toho vyplývající povinnost podnikatele informace spotřebiteli poskytnout. Obecnou povinnost informovat o umělé inteligenci podnikatel nemá. V některých případech je však neinformování nebo nesprávné informovaní možno považovat za nekalou obchodní praktiku. Tento článek se zabývá povinností informovat spotřebitele o umělé inteligenci. Článek rozebírá nejen platnou právní úpravou, ale i návrhy orgánů Evropské unie na budoucí regulaci umělé inteligence.
Artificial intelligence is increasingly used in consumer products. Artificial intelligence can pose risks to users, in particular a risk of lack of control over the product, loss of privacy or discrimination. A major risk associated with the capability of artificial intelligence to decide autonomously (without human intervention) is the lack of transparency concerning criteria for the decision, and the presence of artificial intelligence in the product. The consumer is considered a weaker party. Therefore, the law provides him with special protection. One of the most important rights of the consumer is the right to information and vice versa the obligation of the entrepreneur to provide them with information. The entrepreneur does not have a general obligation to inform about artificial intelligence. However, in some cases, failure to provide information or misinformation may be considered an unfair commercial practice. This article addresses the obligation to inform consumers about artificial intelligence. The article discusses not only the current legislation, but also the proposals of the European Union institutions for the future regulation of artificial intelligence.
