Článek se týká interpretace § 1044 občanského zákoníku, který je považován za jedno z nejspornějších ustanovení kodexu. Konkrétně jde o otázku, zda dané ustanovení poskytuje absolutní ochranu relativním právům. Autoři po velmi důkladném rozboru pravidla (i za použití zahraniční komparace) dospívají k jednoznačnému závěru, že dané pravidlo nepředstavuje případ absolutní ochrany relativních práv.

The paper deals with the interpretation of § 1044 of the Civil Code, which is considered one of the most controversial provisions of the Code. In particular, it is a question whether that provision provides absolute protection of relative rights. After a very thorough analysis of the rule (even using foreign comparisons), the authors come to the unequivocal conclusion that the rule does not represent a case of absolute protection of relative rights.
