Příspěvek polemizuje s některými názory ohledně právní úpravy svěřenských fondů nedávno publikovaných různými autory. Jde o názor, podle něhož by měl být svěřenský fond považován za právnickou osobu, názor, podle kterého nemůže nastat úpadek svěřenského fondu, názor, podle něhož si nelze vyhradit možnost změn statutu svěřenského fondu, a názor, podle něhož majetek vyčleněný do svěřenského fondu mortis causa neprochází dědickým řízením. Všechny tyto názory příspěvek vyvrací.

The paper argues with some views on the regulation of trust funds recently published by various authors. These are the view that the trust should be considered a legal entity, the view that the trust cannot go bankrupt, the view that the possibility of amending the trust's statutes cannot be reserved, and the view that the assets allocated to the mortis trust are not decided about in inheritance proceedings. All these views are refuted by the paper.
