Kapitola se zaměřuje na některé z velkých změn, které byly do systému vládnutí a práva v habsburské monarchii vneseny za vlády Marie Terezie a které předznamenávají nástup moderního ústavního práva. Pozornost je tak věnována horizontální dělbě moci, která se prosadila zejména mezi výkonnou mocí a soudnictvím, vzestupu psaného práva a počátkům moderního legislativního procesu, náběhům k právnímu státu, v němž panovník nezasahuje do výkonu soudnictví, jakož i debatě o přirozených právech. Ač zavádění uvedených změn vycházelo především z pragmatických a utilitárních důvodů, byly tak položeny základy, na které později navázal moderní konstitucionalismus. Vláda Marie Terezie navíc dokázala uvedené změny prosazovat bez revolučních excesů a otřesů, v čemž lze spatřovat inspiraci i pro „tekutou modernitu“ dneška.
The present chapter analyses some of the great reforms in the governance and laws of the Habsburg Empire which were implemented during the reign of Maria Theresia and precede the advent of modern constitutional law. The attention is, thus, devoted to horizontal separation of powers which led, in particular, to separation of the Executive and the Judiciary, rise of legislation and beginnings of modern legislative drafting, tendencies towards rule-of-law State where ruler does not interfere with the administration of justice and, also, debate on natural rights. Although the rationale for implementing these reforms was primarily pragmatic and utilitarian, the bases on which modern constitutionalism later built had been, therefore, laid down. The reign of Maria Theresia, moreover, succeeded in enforcing these reforms without revolutionary excesses and turbulences, an aspect which can be inspiring even in the contemporary period of liquid modernity.
