    Článek se zabývá tím, zda je retroaktivita klasifikačním pojmem nebo diskursivním. Při analýze pojmu retroaktivity tematizuje rozlišování negu mezi pravou a nepravou retroaktivitou, ale především mezi těmito pojmy a retrospektivou. Závěrem argumentuje, že retroaktivita není diskurzivním pojmem.

    The presented article in the beginning analyses various definitions of retroactivity and classification of various situations connected with the intertemporal effect of legal norms in the works of various Czech legal scholars. On the basis of this analysis it tries to identify and solve various problems (e.g. by distinguishing between material and formal applicability of legal norm). Then it presents its own classification of various situations connected with the intertemporal effect of legal norm and stress the importance of distinguishing between “real” retroactivity (Echte Rückwirkung), “apparent” retroactivity (Unechte Rückwirkung) and retrospectivity. It tries to argue that “real” retroactivity is not used in practice and that retrospectivity is used instead. Then it discusses the possibility to understand the concept of retroactivity as a legal principle and concludes that if we accept this understanding, then the concept of retroactivity becomes irrelevant. It also analyzes the concept of retroactivity as an essentially contested concept, and establishes the distinction between legal principles and essentially contested concepts and concludes that we shall still maintain such understanding of retroactivity which treats it as a criterial concept and only afterwards we shall decide whether some intertemporal effect of legal norm is unacceptable in the light of legal principles.
