Článek se z právně-teoretické perspektivy kriticky zamýšlí nad možností konceptu právní subjektivity zvířat a práv zvířat jako práv obdobných lidským právům, po nichž v rostoucí míře volají hlasy ochránců zvířat; východiskem jsou změny v pojímání právní subjektivity, ke kterým došlo v teorii práva v průběhu 20. století. Autorka se přiklání k posílení stávajících nástrojů ochrany a welfare zvířat, namísto rozšiřování konceptu lidských práv o práva zvířat.

From the perspective of Theory of Law, the article critically reflects on the possibility of the concept of legal personhood of animals and animal rights as rights similar to human rights, to an increasing extent called for by animal protectors. This issue was solved by changes in the conception of legal personhood that took place in Theory of Law during the 20th century. The author tends to strengthening of the present tools of animal protection and welfare instead of widening the concept of human rights so that it covers animal rights.
