Článek popisuje teoretické otázky vymezení charakteru vztahu mezi zaměstnavatelem a zaměstnancem, tedy základního právního vztahu, který svojí realizací zároveň tvoří zásadní předmět základního pracovněprávního vztahu. Téma článku tak svou povahou vychází z historických zkušeností a pojetí závislé práce, zároveň však zohledňuje na druhé straně moderní projevy osobního vztahu mezi zaměstnavatelem a zaměstnancem.

The article desribes theoretical issues regarding the definition of the nature of the employer-employee relationship, i.e. the fundamental legal relationship which, by its implementation, at the same time constitutes the basic subject-matter of the fundamental employment relationship Therefore, the topic of this article, is by its nature based on historical experience and the concept of dependent work; however, it also takes account of the modern displays of the personal employer-employee relationship.
