Kapitola Informovaný souhlas nezletilých pacientů pojednává o jednom ze základních práv dětského pacienta - právu na informované (spolu)rozhodování dětského pacienta v kontextu poskytování zdravotních služeb. S odkazem na Úmluvu o právech dítěte a Úmluvu o lidských právech biomedicíně se vysvětluje, že i dětský pacient má právo na to být účasten rozhodování o zdravotní péči. Zákon o zdravotních službách konkrétní stanoví, že při poskytování zdravotních služeb nezletilému pacientovi je třeba zjistit jeho názor na poskytnutí zamýšlených zdravotních služeb, jestliže je to přiměřené rozumové a volní vyspělosti jeho věku. Tento názor musí být zohledněn jako faktor, jehož závažnost narůstá úměrně s věkem a stupněm rozumové a volní vyspělosti nezletilého pacienta a dále že nezletilému pacientovi lze zamýšlené zdravotní služby poskytnout na základě jeho souhlasu, jestliže je provedení takového úkonu přiměřené jeho rozumové a volní vyspělosti odpovídající jeho věku.

The chapter Informed Consent of Minor Patients deals with one of the fundamental rights of the child patient - the right to informed (co)decision-making of the child patient in the context of the provision of health services. With reference to the Convention on the Rights of the Child and the Convention on Human Rights in Biomedicine, it is explained that the paediatric patient also has the right to be involved in health care decisions. The Law on Health Services specifically provides that when providing health services to a minor patient, his/her opinion on the provision of the intended health services shall be sought if it is appropriate to the patient's intellectual and voluntary maturity. That opinion must be taken into account as a factor which increases in importance in proportion to the age and degree of mental and volitional maturity of the minor patient, and further that the minor patient may be provided with the intended health services on the basis of his or her consent, if the performance of such an act is appropriate to his or her mental and volitional maturity in relation to his or her age.
