Within a panel devoted assessment of the modernization or termination of the Energy Charter Treaty (ECT), the presentation focused on climate change provisions contained in the ECT’s ‘agreement in principle’ that would give states, as contractual parties to the ECT, sufficient backing to tackle climate change without facing investor lawsuits. The climate change and decarbonisation provisions of the modernised ECT were further compared with those of the EU-Canada Comprehensive Economic and Trade Agreement (CETA), which a number of European states have already ratified.
