Kapitola představuje klimatickou litigaci jako významný prvek klimatického práva a současný trend. Úvodem je představen historický vývoj tohoto trendu a různé typy klimatické litigace. Ve stěžejní části kapitoly jsou představeny významné případy ve čtyřech skupinách: klimatická litigace u mezinárodních a regionálních soudů a kvazisoudních orgánů, klimatické žaloby napadající klimatické politiky států, klimatické žaloby proti jednotlivým projektům a klimatické žaloby proti soukromým společnostem. Závěrem kapitoly jsou načrtnuty právní výzvy, se kterými se v oblasti klimatické litigace setkáváme.

The chapter introduces climate litigation as an important element of climate law and a current trend. The historical development of this trend and the different types of climate litigation are introduced. In the key part of the chapter, important cases are presented in four groups: climate litigation in international and regional courts and quasi-judicial bodies, climate lawsuits challenging national climate policies, climate lawsuits against individual projects, and climate lawsuits against private companies. The chapter concludes by addressing legal challenges in climate litigation.
