Předložený článek představuje vývoj pravomocí EU v oblasti veřejného zdraví a zejména v oblasti potírání infekčních nemocí a jiných přeshraničních zdravotních hrozeb. I když pravomoci, které byly EU od Maastrichtské smlouvy do současnosti svěřeny, mají převážně podpůrnou povahu a primárními nositeli pravomocí v oblasti veřejného zdraví zůstávají členské státy, nejsou pravomoci EU zcela zanedbatelné a neznamenají, že by EU musela být ve vztahu k přesharničním zdravotním hrozbám pasivní. O tom svědčí i existence systému epidemiologického dozoru, včasného varování a koordinace reakce, který v EU vznikl od 90. let. Pokud tento systém v pandemii covid-19 nefungoval tak, jak se čekalo, plyne to, jak se zdá, více z důvodů faktických než z důvodů právních.
The present article deals with the evolution of EU powers in the area of public health, in particular, in the area of fight against infectious diseases and other cross-border threats to health. Even thought the powers, which have been conferred on the EU in the period ranging from the Maastricht Treaty till present, are mostly the complementary ones, which implies the Member States continue to possess the primary powers in the area of public helath, EU powers are not completely negligible and do not signify teh EU should remain passive with respect to cross-border threats to health. This can be illustrated by the existence of the system of epidemiological surveillance, early warning and response, which has been built in the EU since the 1990s. If this system did not work in the covid-19 pandemic in line with the expectations, this seems to be due to factual rather than legal reasons.
