Článek rozebírá stávající judikaturu Evropského soudu pro lidská práva (ESLP) týkající se ochrany a přístupu k ochraně kulturního dědictví. Ač je tato judikatura často kritizována za to, že otázky kulturního dědictví nahlíží příliš úzce prizmatem zásahů do práva na pokojné užívání vlastnictví ve smyslu čl. 1 Protokolu č. 1 k Evropské úmluvě o ochraně lidských práv a základních svobod (EÚLP), článek argumentuje, že přínos této judikatury není přesto zanedbatelný.

The present article analyzes the existing case-law of the European Court of Human Rights (ECtHR) which pertains to cultural heritage protection and access to cultural heritage. While this case-law is often criticized for seeing cultural heritage issues too narrowly through the prism of interferences with the right to peaceful enjoyment of property under Article 1 of Protocol 1 to the European Convention on the Protection of Human Rights and Fundamental Freedoms (ECHR), the article argues that the impact of this case-law is not negligible.
