Článek analyzuje zakotvení a vývoj interpretace ústavního práva na ochranu zdravého životního prostředí v belgické Ústavě a porovnává jeho dosažené přínosy se situací v České republice. Podává rozbor dvou nových výkladových principů práva životního prostředí, které byly v Belgii v souvislosti s aplikací tohoto lidského práva vytvořeny, a které nejsou v ČR používány: zásady „standstill“ (zákaz regrese právní úpravy ochrany životního prostředí) a zásady „in dubio pro natura“ (v pochybnostech ve prospěch přírody).

The article analyses the constitutional provisions recognizing the right to the protection of a healthy environment in the Belgian Constitution and the development of its interpretation, and compares the contributions of this right to the situation in the Czech Republic. It presents two new interpretative environmental law principles that where developed in connection with the right´s application in Belgium and that are not known in the Czech Republic: the “standstill” doctrine (principle of non-regression) and the principle “in dubio pro natura” (when in doubt, in favour of nature).
