Článek se zamýšlí nad vhodnými teoretickými modely, které by ESLP mohl uplatňovat při rozhodování o tzv. hard cases, zejména v případech čl. 8 - 11 EÚLP. Na pozadí hodnotového pluralismu, polemizuje s kritikou doktríny volné úvahy, ukazuje potřebu kontextualizace takového rozhodování, kterou právě tato doktrína umožňuje.

This article examines suitable theoritical models and they could assist the ECtHR in adjudicating the case law of the qualified rights (Art. 8 – 11). The article demonstrates the importance of the margin of appreciation doctrine for fulfilling the aims of the ECHR
