Problematika principu ne bis in idem je na vnitrostátní úrovni v právnických řádech, kde je tento princip uznáván, vyřešena a nevyvolává zásadní problémy. Jak ukazuje mezinárodní praxe a úvahy o zavádění nadnárodních jurisdikcí, je nutno tuto problematiku, která byla dlouho omezena na suverénní jurisdikce, řešit.

The problem of the principle ne bis in idem on national level is solved adequately in national legal systems recognizing it and is not connected with any difficulties,. International practice and the endeavour to introduce supranational jurisdictions show, however, that this problem, reserved for a long time to internal jurisdiction of sovereign states, requires solution on international level.
