Information for Users of the Institutional Repository of the Czech Academy of Sciences
The following types of records are available in the Institutional Repository of the Czech Academy of Sciences:
- Bibliographic records that may include full texts
- Data records with datasets stored in ASEP
- Data records with datasets stored in another repository
Licensing Terms
If a license is attached to a work, dataset, or other content, the user is authorized to use the content in accordance with the terms of that license.
In the event of a conflict between the general terms and a specific license, the specific license takes precedence.
1. Bibliographic records that may include full texts
- the license (if provided) is available in the metadata, with the stored full text, or on the publisher’s website.
2. Data records with datasets stored in ASEP
- data records with datasets in ASEP are always accompanied by a specific license that sets forth the terms of use,
- the license is listed in the metadata or with the dataset.
3. Data records with datasets stored in another repository
- use is governed by the terms of the license listed in that repository.
Use of Content without an Explicit License
Works stored in the Institutional Repository of the Czech Academy of Sciences are protected by Act No. 121/2000 Coll., on Copyright, as amended (hereinafter the “Copyright Act”).
If no specific license is specified for a work, the work may only be used to the extent permitted by the Copyright Act, in particular:
- for personal use (Section 30),
- within the scope of statutory licenses (e.g., citation, teaching, research).
Citation License (Section 31 of the Copyright Act)
The user is authorized to use the work within the limits of a royalty-free statutory citation license, provided that the author’s name, the title of the work, and the source are cited.
The Copyright Act permits, in particular:
1. the use, to a reasonable extent, of excerpts from published works by other authors in one’s own work,
2. the use of excerpts or short works in their entirety for the purposes of criticism, review, scientific, or professional work,
3. the use of a work in teaching or for the purposes of scientific research, provided that the purpose is not economic or commercial gain.
Limitations on Use
A user may use a work, dataset, or other content only in a manner that does not conflict with the normal course of use and does not unreasonably interfere with the legitimate interests of the author or other rights holder. Any other use is permitted only with the prior consent of the rights holder.
