    Příspěvkem rezonuje teze, že západní svět staví na ideálu sebevědomého a odpovědného občana, protože být člověkem znamená být autonomní. Autor si v úvodu všímá rozdílu mezi učebnicemi občanského práva východoevropských států, pokud jde o výklad zásad soukromého práva. Hlavní tématem referátu je autonomie vůle (privátní autonomie). O ní se v Česku a na Slovensku v dobách komunismu mlčelo. Nyní se stala opět součástí právního myšlení v obou státech. Zároveň ale přežívá z minulých dob (podobně jako v Rusku nebo Bulharsku) myšlenka vzájemné rovnosti osob v civilním právu. Autor zdůrazňuje, že ani v soukromé sféře si osoby ve skutečnosti nejsou rovny a dokládá to příklady. Oč tu jde, je rovnost před zákonem. Souvislost privátní autonomie a informací vidí autor ve třech rovinách. Svobodu jednotlivce omezují zákony. Proto je nutné znát zákonné limity. Legislativní nadprodukce však dnes již vylučuje, aby člověk byl dnes vůbec schopen tyto meze poznat. Dále: pokud mám svobodně jednat, musím se pro správnou volbu rozhodnout na základě informací, případné poruchy řeší civilistické instituty jako předsmluvní odpovědnost, omyl, exkulpace, liberace, pravidlo podnikatelského úsudku a další. Ale někdy normotvůrce ve snaze chránit slabšího, typicky ve spotřebitelském právu, zahltí jednu ze stran takovým rozsahem informačních povinností, že spotřebitel množstvím sdělených údajů nepronikne a ani nemá čas a chuť to dělat. Tak se ochrana míjí účinkem. Třetí rovinu vidí autor v informačním sebeurčení: nejen soukromé subjekty se snaží nabývat a využívat pro sebe často i intimní informace o jiných. Nové technologie tomu otvírají nové možnosti. Vážné ale je, že tyto možnosti lákají i veřejnou moc. Ta do svých databází shromažďuje víc a víc informací o obyvatelích státu pod nejrůznějšími zdůvodněními. S tím není spojeno jen riziko zneužití, ale i riziko úniku do nepovolaných rukou.

    The article resonates with the thesis that the Western world builds on the ideal of a selfconfident and responsible citizen, because being human means being autonomous. The author observes in the introduction the difference between the civil law textbooks of Eastern European States as regards the interpretation of the principles of private law. The main theme of the report is autonomy of will (private autonomy). It was silent in the Czech Republic and Slovakia in the days of communism. Now it has become part of the legal mindset in both states. At the same time, the idea of mutual equality in civil law has survived from past times (as in Russia or Bulgaria). The author emphasises that even in the private sphere, persons are not actually equal and illustrate examples. What's going on is equality before the law. The Association of private autonomy and information is visible to the author in three planes. The freedom of an individual restricts laws. Therefore, it is necessary to know the legal limits. However, legislative overproduction now precludes a person from being able to know these limits today. Furthermore: if I am free to act, I must make the right choice on the basis of information, Possible disturbances are dealt with by the civilian institutes as pre-contractual liability, mistake, exculcations, liberalisation, the rule of entrepreneurial judgement and others. But sometimes the legislator, in an effort to protect the weaker one, typically in consumer law, overwhelms one of the parties with such a magnitude of information obligations that the consumer does not penetrate the amount of data communicated and does not have time and desire to do it. Thus the protection looses the effect. The third plane is seen by the author in the information self-determination: not only private actors try to acquire and use for themselves often intimate information about others. New technologies open up new possibilities. But it is serious that these opportunities attract public power as well. It collects more and more information about the inhabitants of the State under various justifications in its databases. This does not only involve the risk of misuse, but also the risk of leakage to unauthorised persons.
