Autor v článku zdůvodňuje nadpozitivní charakter základních práv a svobod, tj. jejich vynětí z kompetence současného i budoucího ústavodárce. Stať se zabývá některými z těchto základních práv a svobod.

The author justifies the superpositive character of natural rights and freedoms, i.e. their exemption from the competence of the present and future constitutional legislators. The article deals with some of these fundamental rights and freedoms forming the subject matter of polemics, such as the right to strike, the institution of property and expropriation, freedom of expression, individual and collective aspects of minority rights, etc. Extensive notes.
