Wie Hobbes, Locke und Rousseau geht er von einem Naturzustand aus, der in einen politischen Zustand übergehen muss. Der Grund für diesen Übergang besteht darin, dass es im Naturzustand nur unsicher aktueller Besitz gibt, aber kein rechtliches Eigentum. Bei Kant ist der Staat als notwendiges Mittel zur Sicherung des Besitzes und seiner Verwandlung in Eigentum angesehen. Zugleich gilt, dass Kant dem Volk das Widerstandsrecht sowie das Recht auf Revolution abspricht. Beide Forderungen haben zur Folge ein Problem: wenn der Übergang vom Naturzustand zum Staat nur die rechtliche Sicherung des Besitzes darstellt, dann ist dieser Grund ungeeignet, um dem Volk das Widerstandsrecht abzusprechen. Entweder müsste Kant andere Gründe angeben, die den Übergang vom Naturzustand zum Staat ermöglichen, oder er müsste dem Volk das Widerstandsrecht einräumen. Překlad anotace Kant is a proponent of natural rights. Like Hobbes, Locke, and Rousseau, he assumes that there exists a state of nature, which must be superseded by the civil condition. This transition is driven by the fact that in the state of nature, there exists no legally grounded ownership of property, only a rather precarious state of actual holding. Kant views state as an instrument needed to secure holding and transform it into ownership of property. At the same time, Kant rejects the notion that people have the right to resistance or right to revolution. Jointly, however, these claims run into a problem: if transition from the state of nature to the establishment of state were indeed necessitated only by the need for a legal grounding of ownership, there would be no good reason to deny people the right to resistance. Kant must either offer further reasons for transition from the natural state to a state or make allowance for people’s right to resistance.
